Understanding Mediation
Mediation is a private and confidential, structured and informal process where parties who are in conflict meet with an independent person called a mediator. A mediator helps both parties to identify the root cause of their issues, and find potential solutions.
The aim is for both parties to reach an agreement. The process is voluntary (unless directed by the Employment Relations Authority) and the mediator can document the agreement and commitment for both parties to sign at the end of the mediation. People Associates can host these mediations on site, away from the worksite on neutral ground. People Associates mediators are trained, credible, dispute resolution professionals.
Workplace conflict resolution
Often different personalities that are complementary can create friction in the workplace.
To ensure the work environment is safe and productive, employees can benefit from a private and confidential, without prejudice opportunity to work through issues and agree protocol for how best to work with one another safely and professionally in future.
Mediation is a good option to nip these minor conflicts and workplace issues in the bud before they start to affect productivity and other team members.
Post investigation
Often following formal complaints, relationships need repair. Having conducted an independent and formal process, sometimes with disciplinary consequences, tensions can run high and employees need to reset or recalibrate their relationship, debrief the feelings associated with the investigation process, and agree how best to work together moving forward, putting their differences aside. Mediation is the perfect solution to this.
Building stronger relationships
Directors and business owners can have different opinions in relation to important business decisions such as investment or strategy.
In order to support improved decision making and make the most of complementary skills and differing opinions, business owners or leaders can benefit from mediation to help explore and explain differing perspectives and agree a process for how opinions will be shared in future in order to ensure both parties views are heard and respected and individual differences can be set aside for the benefit of the organisation.
Alternative dispute resolution
Presently there is a long waiting list for MBIE assisted mediation given the current volume of personal grievances and disputes.
As an alternative to an MBIE assisted mediation, People Associates has available mediators who can facilitate a process that replicates the MBIE process in order to reach a resolution faster. This is particularly important for employees who are currently employed.
